Recovery Audit Program: Medicare Administrative Contractor (MAC)-issued Demand Letters

Effective January 3, 2012, the Centers for Medicare & Medicaid Services (CMS) transferred the responsibility for issuing demand letters to providers from its Recovery Auditors to the Medicare contractors. This information was released to providers in MM7436.
All Recovery Auditor initiated demands will be issued to providers following the same process as MAC identified overpayments. Providers will be able to distinguish a Recovery Auditor initiated demand notice from a MAC initiated demand notice by reviewing the Letter Number printed at the top right hand corner of each page of the demand notice. If the demand is Recovery Auditor initiated, the Letter Number will contain an R identifier followed by the letter number. The second paragraph of the first page of the demand notice will also indicate, “This finding was a result of a Recovery Audit Program review.”
